Terms of Service

1. TrackeyAI and agreement

These Terms of Service govern access to the TrackeyAI website, Windows application, related services, and updates provided by Morcrane Studios LLC (TrackeyAI, we, us). By affirmatively accepting these Terms, you enter an agreement with Morcrane Studios LLC. If you do not agree, do not download, install, or use TrackeyAI.

2. Limited software license and ownership

Subject to these Terms and any applicable subscription or trial, we grant you a limited, nonexclusive, nontransferable, revocable license to download, install, and use TrackeyAI for your own authorized business or personal purposes. The software is licensed, not sold. All rights not expressly granted are reserved by Morcrane Studios LLC or its licensors.

TrackeyAI software, original source code, confidential implementation details, documentation, trademarks, and protected content remain the property of their respective owners. These Terms do not transfer intellectual-property ownership to you.

3. Prohibited reverse engineering and competitive extraction

Except to the extent expressly permitted by mandatory applicable law, you must not reverse engineer, decompile, disassemble, decrypt, circumvent technical protection measures, extract source code from, or attempt to reconstruct nonpublic implementation details of TrackeyAI.

Without our prior written permission, you must not use automated scraping, crawlers, bots, bulk extraction, unauthorized benchmarking, systematic probing, or automated data collection to reproduce our nonpublic software behavior, interfaces, internal implementation, proprietary workflow configurations, or protected content.

You must not use access obtained under this license to misappropriate our confidential information or trade secrets, publish nonpublic security-sensitive implementation details, or develop or assist a competing product using unlawfully obtained protected material. These restrictions do not prohibit lawful independent development, use of publicly available ideas, activity expressly authorized by us, or statutory interoperability, observation, testing, or other nonwaivable rights.

If applicable law gives you a nonwaivable right to perform an otherwise restricted act, the restriction applies only to the extent permitted by that law. Contact us to request permission for research, interoperability, or benchmarking where permission is legally required.

4. Accounts, access, and security

You are responsible for securing your account and credentials and limiting access to authorized users. Do not share authenticated installer access, republish installers, bypass authentication or license controls, interfere with service operation, or attempt unauthorized access to another account or system.

We may suspend access for a material violation of these Terms, subject to applicable law and any required notice or cure rights. Nothing here authorizes unreasonable surveillance of customer content.

5. Trials, subscriptions, and payments

Eligible new accounts may receive a 7-day trial after completing the applicable Stripe Checkout flow. Paid plans are described on the pricing and billing pages. Stripe processes payment information; TrackeyAI determines subscription entitlement. You may manage or cancel billing through available account controls, subject to applicable subscription terms and consumer rights.

6. Service operation and changes

We may improve, update, or modify the service. We work to maintain reliability, but availability is not guaranteed to be uninterrupted. Material amendments to these Terms may require renewed acceptance before a future installer download.

7. Enforcement, applicable law, and protected rights

Unauthorized disclosure or misappropriation of confidential material may give rise to contractual and other legal remedies where the applicable legal requirements are met. No specific remedy, injunction, damages award, or forum is automatic.

Nothing in these Terms limits rights or remedies that cannot lawfully be waived, including mandatory consumer protections, applicable software-interoperability rights, and applicable law governing permissible security research. Jurisdiction, choice of law, and dispute provisions require separate legal review before inclusion.
